Today, the U.S. House of Representatives and the U.S. Senate, will be hearing about PIPA (PROTECT IP Act - Protect Intellectual Property Act) and SOPA (Stop Online Piracy Act) both of which are aimed to Stop the use of others Intellectual Property (here after referred to IP), this is a full use of IP it is aimed to not only stop the people who use it for monetary gain, but also to stop even "Fair Use" like my stickers. They allow the government to censor websites on behalf of the "Rights" holder. It gives the government TO MUCH CONTROL.
The DMCA (Digital Millennium Copyright Act) was created to protect 'service providers' (Google, Twitter, Facebook, Foursquare, GetGlue, Blogger, ect...) by providing them 'Safe Harbor'. 'Safe Harbor' means that they are not responsible for what the general public posts to their servers so long as they put forth an effort to speedily remove content which infringes copyrights, once the provider has been notified of the content. Usually the provider will contact the user and pass the take down notice to them, and if the user does not take the infringing content down the provider will assist and take down the content, sometimes taking the users account as well. This system makes the provider responsible for its users, but only if the provider fails to follow the guidelines and take down content when requested.
The PIPA and SOPA will give the government the right to step up and say because someone posted a link in the comments on my blog to infringing content, my site will be blocked and no one may visit my site, and then anyone who has a link to my site that does not take it off within a few hours will also get their site blocked, because they are linking to a infringing site. at the same time Blogger will be blocked because my site resides on their servers, and anyone who points a link to blogger will also be required to remove their links of b e blocked as well...
Do you think any site Facebook, Twitter, GetGlue or Google is going to risk losing their whole site over 1 or 2 users, HELL NO they will either close their site (take their money and run) or they will change their model to only allow content that has been either fully checked to not include infringing content or link to any infringing content, which means they have to expend more money to hire people to check the content after a screening bot dumps anything that even remotely looks infringing (like my stickers).
Protecting copyrights is fair and just goal, I just think the government is going about it the wrong way. All these acts will do is send the internet back into the dark ages, if not make it extinct here in America...
